Report: Colorado oil, gas regulators ‘inadequate,’ not enforcing rules

A new report blasts the state agency charged with regulating the oil and gas industry for failing to enforce its own rules.

There were 516 spills in 2011 but the Colorado Oil and Gas Conservation Commission (COGCC) only assessed five fines, according to the report that Earthworks released today.

“The COGCC’s mission is to foster responsible oil and gas development by balancing drilling with protection of landowners, public health, and the environment,” Gwen Lachelt, the director of Earthworks’ Oil & Gas Accountability Project, said in a prepared statement. “Right now, the COGCC’s rules, like its mission statement, are just empty words on a page. There is no balance here.”

As the number of wells drilled increases in Colorado, the number of inspections is decreasing, the report found, noting it is physically impossible for existing COGCC staff to annually inspect every well. The report also claims many rule violations are not recorded. The few who are penalized are subject to maximum fines of ,000 per day, which the report deems “inadequate to deter irresponsible operations.”

“There is always room for improvement in anything that we do,” Colorado Department of Natural Resources spokesman Todd Hartman said on behalf of COGCC. “At the same time, the issues addressed in the report today are not simple. We are and will continue to be aggressive in our enforcement when operators take actions that pose significant threats to the environment and public health.” COGCC’s staff, he added, “works diligently, responsibly and effectively to ensure protection of the public and environment from any potential impacts of oil and gas development in Colorado. We enforce the most comprehensive set of oil and gas regulations in the country, including, beginning April 1, the strongest and most transparent hydraulic fracturing chemical disclosure rules yet adopted in any state.”

The Earthworks report comes amid heated debate about whether local governments should be able to make their own laws regarding oil and gas drilling. Competing bills — one introduced by a Democrat to empower local governments and another one introduced by a Republican to solely empower COGCC — died at the state capitol. Gov. John Hickenlooper recently convened a task force to help clarify and better coordinate” the regulatory jurisdiction between state and local governments.

The task force’s findings are due April 18.

Boulder County, Longmont and Colorado Springs have temporarily halted drilling activity. Commerce City, Erie and Aurora, Arapahoe County, Douglas County, Elbert County, El Paso County and Huerfano County are vying for their own regulations.

The proliferation of hydraulic fracturing, or “fracking,” is fueling much of the community concern.

The U.S. Environmental Protection Agency is studying the risks that fracking poses to drinking water after complaints have been made in Colorado, Wyoming and other states.

This week the University of Colorado-Denver School of Public Health announced that an analysis of residents in Garfield County living within a half-mile of oil and gas fracking operations found they have been exposed to air pollution five times above the federal hazard limit.

U.S. Reps. Diana DeGette and Jared Polis, both Democrats from Colorado, have asked President Obama to strengthen environmental and public health standards to protect against fracking.

“COGCC’s inadequate performance shows why citizens need to have federal standards, as well as state regulations,” Earthworks’ policy director Lauren Pagel said. “In Colorado’s case, state regulation means inadequate regulation, and therefore, irresponsible development.”

She recommended that COGCC increase its inspection staff, standardize and publicize inspections, and increase fines for violations.

COGCC has doubled its staff size over the past seven years during hard economic times, responded Hartman, and the agency will hire an additional seven people, including two more inspectors, over the next fiscal year at a time when government agencies continue to cut budgets.

Moreover, COGCC’s website is “perhaps the most open and informative in the country, with wholesale public access to documents associated with complaints, inspections and alleged violations – as well as all follow-up documents that follow from those,” Hartman noted. “We publish updated statistics monthly on a wealth of material, including violations, complaints, spills, remediation and inspections.”

Still, critics remain.

Last month, 18 conservation and citizen activist groups questioned the ties between industry and regulators at the COGCC and asked Hickenlooper to improve the state’s oversight.

The Earthworks report is just the latest to question Colorado’s ability to regulate the energy industry.

The U.S. Nuclear Regulatory Commission last week criticized the Colorado Department of Public Health and Environment for its oversight of radioactive materials. State officials strongly defended their processes and called the Nuclear Regulatory Commission’s comments “unprofessional.”

Huffington Post report claims Wayne Allyn Root is running for President

The Huffington Post published an article today about the “the more than 300 lesser known Americans who have registered with the Federal Election Commission to run for the highest office in the land.”  Those mentioned include Green Party candidate Mike Ballantine, and Independent candidates “Naked Cowboy” Robert Burck and “Average Joe” Schriner.

The article also claims that Libertarian National Committee member Wayne Allyn Root is running for president:

The smart money may be against a third party candidate, but sports handicapper Wayne Allyn Root, hopes to be the Libertarian Party presidential candidate. The Las Vegas resident served as the party’s vice presidential nominee in 2008 and points to England, where a third-party candidate was able to make an impact in the last election after turning in a great debate performance.

Root is also the executive producer for the Travel Channel’s “Ghost Adventures.” He believes a one-year tax holiday would have been more successful at saving the economy than the stimulus package passed by Congress was. Root would like to introduce a flat tax.

His vocation as a sports handicapper on radio and TV stations isn’t much different from the profession of a stock analyst, he said, noting that critics point to his occupation to marginalize him.

But, Root believes a sports handicapper is well suited to understand the country’s character.

“America is the biggest gambling nation in the world, especially when it comes to gambling on small-business creation,” he said. “It’s the risk-taking entrepreneurs that made America great.”

Despite the report, Root has not filed with the FEC as a presidential candidate and is not currently seeking the Libertarian Party (LP) nomination. Nevertheless, he is often mentioned as a potential vice presidential nominee.

Candidates actually seeking the LP nomination include former air traffic controller RJ Harris, activist R. Lee Wrights, and former New Mexico governor Gary Johnson.

Jane Mayer’s recent New Yorker piece on the criminal prosecution of National Security Agency (NSA) whistleblower Thomas Drake reveals a sliver of the intelligence industrial complex costing Americans’ their money and their freedom.

Drake blew the whistle on the NSA wasting billions and sacrificing Americans’ privacy on what The New Yorker describes as a “.2 billion flop.” The program, Trailblazer, though intended to collect and analyze massive amounts of data, was a funding vehicle with “nothing to show for [itself] other than mounting bills.” NSA management rebuffed and retaliated against Drake and other public servants who pointed to a cheaper, ready-to-deploy program that contained privacy protections for Americans.

Trailblazer’s failure is a prime example of the endemic revolving-door intelligence spending policy that wastes taxpayer dollars by the billions. Mayer’s article describes the problem:

As the Trailblazer system stalled at the level of schematic drawings, top executives kept shuttling between jobs at the agency and jobs with the high-paying contractors. For a time, both [former NSA Director] Hayden’s deputy director and his chief of signals-intelligence programs worked at SAIC, a company that won several hundred million dollars in Trailblazer contracts.

The billions wasted on Trailblazer are a fraction of massively bloated intelligence budget – of which NSA makes up a third. The Washington Post’s Top Secret America profiled how, post-9/11, the intelligence industrial complex exploded, growing into something that cost American taxpayers .1 billion dollars in the Fiscal Year 2010. The details of where that money went are still classified, save to say .1 billion was the National Intelligence Program, which includes most intelligence agencies, and billion was for the Military Intelligence Program. We also know it’s more than double what was spent in 2001, which is no surprise considering the statistics the Post revealed last year:

1,271 government organizations
1,931 private companies working on counter-terrorism, homeland security and intelligence at about 10,000 locations across the U.S.;
since 9/11, 33 new building complexes built or under construction – that’s 17 million square feet of space;
50,000 intelligence reports a year, many of which are routinely ignored;
and over 850,000 people with top-secret security clearances.

Despite the staggering numbers, the request for Fiscal Year 2012 – made public for the first time in history in February – is even greater: billion for the National Intelligence Program.

However, even with tens of billions of their dollars at stake, the American people are still largely in the dark about how their money is spent, with a few exceptions thanks to whistleblowers who couldn’t stand to see Americans’ privacy and security sacrificed for money.

The Department of Defense Inspector General Report substantiating Drake’s concerns about massive NSA waste and illegality is still secret.

The total amount being spent on Intelligence this fiscal year is still secret.

The details of the FY 2012 appropriations request are secret because the Office of the Director of National Intelligence claims disclosing the details “could harm national security.” (By the way, that’s the same argument former CIA director George Tenet employed to keep secret even the total budget request number, a number that, as Steven Aftergood of the Federation of American Scientists highlighted, the current Director of National Intelligence released.)

When the first total intelligence spending number was released for FY 2010, after a decades-long battle led by transparency advocates, Congressional Leaders committed to reducing overspending. Then-Chair of the Senate Select Committee on Intelligence Sen. Dianne Feinstein (D-Calif.) assured taxpayers that:

I intend to identify and remove any waste and unnecessary duplication in the intelligence budget and to reduce funding for lower-priority activities . . . it is clear that the overall spending on intelligence has blossomed to an unacceptable level in the past decade.

Yet, Feinstein sat on the Intelligence Committee during the Trailblazer debacle, when the total intelligence budget numbers were still secret. Meanwhile, the whistleblower who helped expose Trailblazer for the money pit that was has been charged with violating the Espionage Act and is set to stand trial on June 13th.

Taxpayers are funding the retaliatory prosecution.

A Report on the Recent Constitution Party National Committee Meeting

By every measure…attendence…energy and enthusiasm….reception for the speakers….and simply in terms of overall accomplishment…the Spring 2011 Constitution Party National Committee Meeting and Conference in Harrisburg was considered a major triumph!  Many said it was the best they ever attended, though travel for many of the members coming from the South and Midwest got off to a very rocky start due to storms across much those parts of the country.

Once everyone was finally assembled–and even before some arrived– the meeting hit a positive stride on Friday morning with dramatic presentations by Ohio’s Robert Owens, and Pennyslvania’s Peg Luksik on Friday morning followed by a tour of the beautiful Pennsylvania State Capitol Building.  On Friday afternoon John McManuns, president of the John Birch Society, provided a sobering picture of the history of the United Nations and Chelene Nightingale put the magic of her dynamic personality on display during a powerfully motivational address where she reviewed her 2010 campaign for Governor in California and exhorted everyone to continue to make the greatest possible effort to build the Constitution Party.

The Friday Night banquet featured a lively auction conducted by Midwestern StatesCo-Chairmen, Randy Stufflebeam (IL) and Scott Bartlett (SD) which raised money for the national committee’s operational fund.

The featured speaker, Sheriff Richard Mack received a thunderous standing ovation after he completed his address on the role of the County Sheriff in saving our Republic.  Mack endorsed numerous Constitution Party candidates in 2010,   It is certainly hoped that he will not be a stranger at Constitution Party events in the future.  Many at the meeting voiced a hope that he would play a high profile role for the Constitution Party in the upcoming 2012 election.

Also highlighting the banquet were two awards presented to three term national CP chairman, Jim Clymer–the America First Award presented on behalf the the Constitution Party’s National Veterans Coalition and the Excellence in Leadership Award presented on behalf of the Lancaster (PA) County Committee of the Constitution Party.

The energy remained at a high level on Saturday the 3oth.  The morning was kicked-off with an informative and entertaining portrait of Pennsylvania provided by Jim Panyard, former President of the Pennsylvania Manufacturing Association, followed by an intriguing and warmly received review of the current political situation, including the work of the so-called Human Rights Tribunals, provided by Victor Chiasson a political conservative from Ottawa Canada with very close ties to the Constitution Party.  Without a doubt, Dr.Taylor Haynes of Wyoming, who secured about 8% of the vote as a write-in candidate for Governor in 2010 was one of the real crowd favorites.  A newcomer to the Constitution Party, Dr. Haynes is a man of enormous personal accomplishment–any one of the items on his lengthy resume’ would probably thrill most us–yet great humility.  His discussion of the 2010 campaign, which he centered on the Constitution and the Ten Commandments, inspired everyone in attendance. Darrell Castle provided an information packed overview of the situation in the Middle East raising very justifiable questions concerning the role that has been played by the United States over the years in the part of the world.  His presentation brought specific praise from the last speaker, former Virginia Congressman Virgil Goode who, as noted above said that it is time that America start taking care of its own serious problems rather than trying to cure the rest of worlds ails. The general consensus was that it was Goode’s finest and most powerful address since he first started attending Constitution Party national meetings in 2009  and was a portent of great things to come.

Joelle Riddle: Independent Leader in Colorado Report from the Field, E-Day 2010

Joelle Riddle was one of three full-time La Plata County Colorado Commissioners since winning the election in 2006. Not a newcomer to the political arena and policy making, Riddle was a Young Democrat and then chair of the La Plata County Democratic Party prior to changing her affiliation to “independent” to better serve the people of La Plata County. She was prevented from running for re-election by Colorado state law which imposes a 17-month waiting period for candidates who disaffiliate, a law that she and other nonpartisans challenged in the courts. Riddle was honored this year with an Extraordinary Leader Award during the Women’s Resource Center’s Girls Night Out for her education work with Planned Parenthood, the various constituencies she has represented as a commissioner and founding the independent Voters for Colorado.

E-Day

Election Day November 2, 2010, turned out to be a very personal experience for me. I knew that this day more than any other would be the beginning of the end as far as my current capacity to serve as an elected official.

It was clear several months ago that I was not going to be on the ballot, having discovered the inequities in Colorado law immediately after changing my affiliation from Democrat to independent (or unaffiliated). It was further affirmed I wasn’t going to be on the ballot after a federal court judge ruled that there would be no changes to the rules set in place by the parties to blatantly advance their candidates and discourage others.

I knew it, but on Election Day I felt it.

Being on the “inside” allowed me to experience the consequences of a broken system and how it fails the people and the issues that are most important to us on a regular basis, day after frustrating day. Until the system changes we won’t have qualified candidates, we won’t solve problems and we won’t regain the public trust. 

It was sobering in a way that I hadn’t imagined as I looked at the list of candidates on the ballot and didn’t see my name, as I had four years earlier. To not win an election is one thing, but to be prevented from even running is another — very frustrating — experience all together.

Although I experienced this intense feeling of injustice and frustration (as most independents do at one time or another, I imagine) it was juxtaposed with a very deep sense of relief, a relief that I would no longer have to work within a broken, dysfunctional system. The effects of our partisan politics are felt at every level, and if you are someone that thinks it only affects our elected officials in DC, then think again—it’s thought, felt and ingrained into all levels of our political process, even in our small rural communities, and that’s exactly where we need to start the reform.

I spent the last four years learning and understanding countless processes, participating in numerous local and state boards to advocate for my community, studied issues I had never even heard of prior to taking office. I built relationships based on trust in order to continue to do the best job I could for my community. And really all of that didn’t amount to much in the end as far as the “system” was concerned. Everything boiled down to the fact that I didn’t want to play for just one team; I wanted to work for all of the people, with no biased party labels or preconceived notions. For me it was a natural evolution and a product of my observations and learning.

Being on the “inside” allowed me to experience the consequences of a broken system and how it fails the people and the issues that are most important to us on a regular basis, day after frustrating day. Until the system changes we won’t have qualified candidates, we won’t solve problems and we won’t regain the public trust.

I knew when I made the decision to become an independent that there would be consequences, some rather predictable and others I couldn’t have imagined.

One thing was for certain, independence was the only way forward that would allow me to do the best job I could for the people I was elected to represent.

I have never regretted that decision and it has proven to not only affirm my passion for democracy, it has elevated it to a level that will inspire my work as a grassroots organizer for “Independent Voters for Colorado”.

Although I wasn’t re-elected to office, I know that my commitment to the people in my community is deeper and I am even more determined to help change our government. In the future I want to contribute to a more authentic expression of our democracy; a productive political process and not just a power game for political parties who seem to be concerned for their own “win” as opposed to genuine gains for those whom they purport to serve. I would venture to say that my next Election Day report won’t be fraught with so much frustration, but more of a sense of accomplishment in working with other independents to organize and demand a better democratic process.

Biden: Israeli Report on Iran ‘A Lie’

Democratic vice presidential nominee Joe Biden is denying a report that he secretly told Israeli officials they would have to accept the idea that Iran will acquire nuclear weapons.

Israeli Army Radio said on Monday that the senator from Delaware, chairman of the Senate Foreign Relations Committee, met with “senior Israeli officials” behind closed doors during a visit several years ago and told them: “Israel with have to reconcile itself with the nuclearization of Iran.”

Biden reportedly told the officials he opposed “opening an additional military and diplomatic front” against Iran.

But Biden spokesman David Wade declared in comments reported by ABC News: “This is a lie peddled by partisan opponents of Senators Obama and Biden, and we will not tolerate anyone questioning Senator Biden’s 35-year record of standing up for the security of Israel.

“Joe Biden’s first trip as a Senator was to Israel, he has worked with every Israeli leader from Golda Meir to Prime Minister Olmert, and he takes a back seat to no one when it comes to protecting the relationship between Israel and the U.S.

“Senator Biden has consistently stated – publicly and privately — that a nuclear Iran would pose a grave threat to Israel and the United States and that we must prevent a nuclear Iran.”

As Newsmax reported on Monday, Biden has been an ardent supporter of the state of Israel in the Senate. His selection as Barack Obama’s running mate was seen as an effort to shore up support with the U.S. Jewish community.

During the primaries Obama argued for direct negotiations with Iran, and he has avoided making any suggestion that the U.S. should take military action against Iran.

Florida House Representative Jennifer Carroll who is the Republican Party's
candidate for Florida's lieutenant governor was the keynote speaker for the
Fifth Anniversary Celebration of the National Black Republican Association
that was held in Sarasota, Florida on September 16, 2010. During the
festivities a congratulatory letter from RNC Chairman Michael Steele was
read and awards were presented to NBRA grassroots activists and supporters.
Among the awardees were Sarasota County Commissioner Carolyn Mason who was
presented with the NBRA's Chairman's Award and seven of our grassroots
activists who were recognized as NBRA Pioneers. At a previous quarterly
meeting of the Republican Party of Florida, Rep. Carroll was honored with

Announced during the NBRA Fifth Anniversary event was the play, The Women of
Bradville, written by NBRA Chairman Frances Rice about the true history of
civil rights that is being produced by Bowie State University (BSU) in
Maryland. The first reading of the play was held at The Kennedy Center on
September 5, 2010 and will be premiered at BSU in 2011. A notice will be
posted on the NBRA website and NBRA Facebook page as soon as the date of the
premier is announced by BSU.
