Senate committee passes bill to stop pre-employment credit checks

Monday evening the Senate Judiciary Committee approved Senate Bill 3, the Employment Opportunity Act, sponsored by Sen. Morgan Carroll, D-Aurora. The Act prohibits pre-employment credit checks that some companies use to screen candidates. Sponsors of the bill say such credit checks can prevent people with low credit scores from finding employment. The bill passed 4-3 on a party line vote.

“Credit scores were never intended to be used in hiring practices,” Carroll said in a statement released after the bill made it through committee. “Tying credit scores with employment opportunity creates a vicious circle that unfairly punishes struggling Coloradans. We should be doing everything in our power to get citizens back to work, and this legislation ensures that we are removing unnecessary punitive barriers and helping citizens get back on their feet.”

Senate Bill 3 prohibits employers from using credit report information unless it is directly related to the position for which a candidate is applying, such as a money or asset management role. If the employer decides not to hire an individual based on information from their credit report, they must disclose this to the applicant. Employers found in violation of this law would be subject to civil penalty. Seven other states have enacted similar laws to prevent credit report discrimination.

Approximately 25.5 percent of Americans currently have poor credit compared with a historical average of 15 percent, and it is estimated that up to 60 percent of employers currently run credit checks on prospective employees.

The bill will now be considered by the full Senate. The bill is sponsored in the House by Rep. Randy Fischer, R-Fort Collins. Republicans who voted against the bill in committee did not quickly return phone calls seeking comment.

Martin Luther King, Jr. Day is a United States federal holiday marking the birthday of Rev. Dr. Martin Luther King, Jr.   It is observed on the third Monday of January each year, which is around the time of King’s birthday, January 15.    The floating holiday is similar to holidays set under the Uniform Monday Holiday Act, though the act predated the establishment of Martin Luther King, Jr. Day by 15 years.

King was the chief spokesman for nonviolent activism in the civil rights movement, which successfully protested racial discrimination in federal and state law.    The campaign for a federal holiday in King’s honor began soon after his assassination in 1968.   Ronald Reagan signed the holiday into law in 1983, and it was first observed on January 20, 1986.     At first, some states resisted observing the holiday as such, giving it alternative names or combining it with other holidays.    It was officially observed in all 50 states for the first time in 2000.

Super Committee failure could hit unemployed in the wallets

The failure of the congressional “Super Committee” to reach an agreement jeopardizes the federal unemployment benefits of almost 2 million unemployed workers, according to the National Employment Law Project.

The “Super Committee” is made up by 12 lawmakers — three Senate Democrats, three Senate Republicans, three House Republicans and three House Democrats — charged with drafting legislation to cut at least .2 trillion out of the deficit over the next 10 years.

The National Employment Law Project — which promotes “policies and programs that create good jobs, strengthen upward mobility, enforce hard-won worker rights, and help unemployed workers” — wrote Monday:

The real failure of the Joint Select Committee is not the lack of a deficit-cutting agreement, which poses no threat to the economy, but rather the failure to reauthorize the federal unemployment insurance programs that expire on December 31st. Unless Congress acts promptly, the economy will take another hit in the New Year as two million unemployed workers will lose the modest federal benefits they rely on to get by and that, in turn, support businesses in their communities.

Not eveybody agrees on the impact of the committee’s failure to reach cuts. Accoeding to Mark Zandi, chief analyst at Moody’s Analytics, “the economy will suffer in 2012 if a congressional supercommittee fails to come up with ways to trim the country’s deficits.”

A March 2011 report (.pdf) issued by the Research Institute on Social and Economic Policy and the National Employment Law Project indicates that “unemployment compensation has provided a net benefit to Florida’s economy of over .8 billion since the beginning of the recession, combining both the state program and federal extension programs.”

A study released in October by the conservative Tax Foundation shows that Florida has the fifth lowest unemployment benefits in the country.

The Employment Law Project adds that “over the past three years, federal unemployment insurance has helped more than 17 million Americans while they’ve looked for new work in the toughest job market since the Great Depression.”

“Hanging on By a Thread,” a National Employment Law Project report issued in October, indicates that:

  • 1.8 million workers who currently receive federal unemployment insurance or would have begun to receive it will be cut off if Congress does not renew the program before it expires on December 31st.
  • Of these 1.8 million workers, more than 430,000 were laid off as recently as July and will reach the end of their state benefits in January without the prospect of any federal relief, if Congress fails to act.
  • Nearly 650,000 workers in 33 states and the District of Columbia will face an immediate “hard” cut‐off of their benefits in January.
  • Congress has never cut back on federally‐funded unemployment insurance when unemployment was anywhere near this high for this long. The highest unemployment rate when federal benefits were cut by Congress was in 1985, at 7.2 percent. Today, the unemployment rate stands at 9.1 percent.
  • Unemployment insurance kept 3.2 million people (including nearly one million children) from falling into poverty.
The study adds that the average unemployment monthly benefit amounts to almost ,300 — “only half of basic household expenditures.”

U.S. Rep. Jared Polis was among Colorado Democrats unhappy with the supercommittee’s failure.

“Once again, Congress has failed the American people. This type of dysfunction is becoming more and more typical of Congress,” Polis said in a prepared statement. “This is particularly upsetting considering there were already two bipartisan road maps for resolving our debt crisis that have been submitted. Either the Bowles-Simpson plan or the Gang of Six report can be the foundation for a bipartisan solution to address the debt crisis and ensure that our nation returns to strong financial footing. I call upon Congress to address our fiscal crisis immediately.”

Rep. Diana DeGette had this to say:

“While I join Americans in expressing disappointment that the 12-member Super Committee was unable to fulfill its task of developing a deficit reduction plan, all is not lost. The time has now come for Congress as a whole to fulfill its responsibility to the American people and come together to develop and pass a balanced approach to reducing our national deficit and growing our economy.

“A broad range of economists and the American people understand that reducing the deficit will require a combination of responsible spending cuts, that do not place undue burdens on those who can afford it the least, and adjustments to our tax code, that ensure low-income and middle-class Americans have the same opportunities as the wealthiest among us. It is time for their leaders to understand that as well.

“Congress must end the political gamesmanship that has overwhelmed this session and prevented us from accomplishing important work for the American people. I’m certain my colleagues from both sides of the aisle agree, and will finally focus on a balanced approach that includes the cuts, investments, and revenue enhancements that are essential to America’s ability to reduce our deficit, and ultimately compete in the 21st century global marketplace.”

Senator Mark Udall also blasted the committee for failing to reach agreement:

“Today’s news is disappointing and frustrating for Coloradans who want leaders capable of making tough decisions and guiding our nation through difficult times. Our trillion debt is the biggest national security challenge we face, threatening our leadership in the world. Businesses across the country have told us that they need certainty that our nation’s debt won’t crush our economy in order to start hiring again. And Americans looking for work, at risk of losing their home or struggling to keep a small business running, were counting on Congress to make the first big step toward fiscal responsibility and economic recovery.

“The failure of the super committee means that once again, when it mattered most, Congress failed to do its job. In order to cut our debt, Americans agree that everything needs to be on the table – including spending cuts and revenue increases. Everyone needs to give. Tragically, it seems that some members of Congress were more concerned about a pledge they made to a special interest lobbyist – and protecting their own careers – than in doing the job they were elected to do.

“Where do we go from here? Regardless of who is to blame for the failure of the super committee, we now face automatic cuts across the board, including to defense – cuts that are going to hurt. As one of the small group of senators who pushed two years ago to create what became the Bowles-Simpson Commission on debt and deficit reduction, I’m urging Congress to vote on the Bowles-Simpson plan. It’s a balanced proposal that will make tough spending cuts, raise some new revenues, shore up Medicare and Social Security and get our nation’s economy back on track. Congress should also pass the balanced budget amendment that I’ve proposed, which will prevent special interest tax breaks and protect Social Security, while ensuring Congress will never get us into this mess again.”

Details of Constitution Party Fall National Committee Meeting

From Gary Odom, here are the latest details on the Constitution Party’s Fall meeting.

The Constitution Party’s Fall meeting will be held in Coeur d’Alene, Idaho.

The location selected is the famously beautiful Coeur d’Alene Hotel and Resort, 115 South Second Street, Coeur d’Alene, ID 83816. It can never be said that our state affiliates don’t have a neighborly attitude. The Constitution Party of Washington is hosting this meeting, and it was they who suggested that the best place to hold the meeting would be ….. in Idaho about thirty miles east of Spokane. The Coeur d’Alene is a world class resort located on the shores of the idyllic Lake Coeur d’Alene. Grab this opportunity to visit the beautiful northwest, while working with Constitution Party leaders from all over the country to plan the 2012 presidential nominating convention, and work on strategy for the presidential election, state party development and ballot access.

Fourteen LNC Members File Joint Response to Judicial Committee Appeal

Fourteen members of the Libertarian National Committee (LNC) on July 28 submitted their response to the appeal filed by the Wes Wagner group claiming to lead the Libertarian Party of Oregon (LPO). 

The June 19 appeal by the Wagner group claims that the LNC Executive Committee’s recognition of the Reeves group on June 18 was a constructive disaffiliation and should have required a three-quarters vote of the entire LNC. 

The nearly 70-page set of documents (Document 1 of Response by LNC) (Document 2 of Response by LNC) (Appendix Assembly of Response by LNC) submitted by Chairman Mark Hinkle – and signed by a broad cross section exceeding three-fourths of the eighteen-member governing board – denies that Wes Wagner could be a party to an appeal because Wagner has not been the chair of the LPO since May 21 and states that no disaffiliation took place. 

The LNC response describes its actions as necessary to protect the autonomy of its Oregon affiliate from a “rogue board of directors.”

The comprehensive submission provides a timeline of events, along with a number of arguments and documentation in support of its conclusions that

  • There exists a distinction between disaffiliation and recognizing legitimate officers
  • There are numerous reasons as to why the LNC needs to ascertain the identity of officers of affiliates to remain in compliance with its bylaws
  • Acknowledging legitimate officers elected by LPO members in accordance with their bylaws is not a violation of affiliate autonomy
  • Wagner’s own public statements reveal he believes his board does not have the authority to amend the bylaws
  • There exists a clear rationale for why LPO’s bylaws must lead one to conclude that the group of officers led by Tim Reeves are the legitimate officers of the LPO
  • Wagner’s position is at odds with the very state law he claims as justification
  • Not recognizing the officers led by Tim Reeves would have been equivalent to disaffiliating the long-standing LPO – without the required ¾ vote – and affiliating with a newly created organization, with a different set of bylaws and different set of members

Forrester Elected to DNC Executive Committee

NASHVILLE, Tenn. — Chip Forrester, the chairman of the Tennessee Democratic Party, accepted a larger role in the national Democratic Party Friday with his election to a governing body with national influence.

Forrester will serve a term on the Democratic National Committee’s Executive Committee, the policy-making arm and governing body of the national party.

Forrester was elected unanimously to the DNC Executive Committee at a meeting of the Association of State Democratic Chairs. He will serve as that group’s Southern Chair on the DNC Executive Committee and will work as a representative for the region.

The new role will give Tennessee a more powerful voice in national affairs and policy decisions, particularly during the upcoming 2012 election.

“I am honored to have the unanimous support of my colleagues, other state chairs and vice chairs, who have expressed their confidence in me by electing me to this important national position on our party’s Executive Committee,” Forrester said. “I have promised them that I will faithfully ensure that state parties are heard and their needs addressed at DNC Executive Committee meetings.”

So if I wake up in a daze and shake the dust off and a guy named Saint Peter asks me what I was doing when the world ended?    I’ll have to tell him I was enjoying breakfast at Rojo’s Corner Grill in Appomattox with our wonderful Democratic friends and their families from all over the new Virginia Senate 22nd District.   The truth is God is everywhere and he’ll be there with us at breakfast.

Using numerology based on dates and time-frames mentioned in the Bible, Camping has determined that the rapture will occur at 6:00 pm, May 21st.    It will be a sweeping rapture, hitting each time zone as they reach 6 pm.
  
Harold has missed before.   Why don’t these nutjobs ever forecast good things?    The hungry will be fed, the sick will have medical care and the world will be swept with blessed peace.    A group that only shines a light on negativity, whoa!  thats the GOP.

When the clock says about 6 p.m., there’s going to be this tremendous earthquake that’s going to make the last earthquake in Japan seem like nothing in comparison.    And the whole world will be alerted that Judgment Day has begun.    And then it will follow the sun around for 24 hours.     As each area of the world gets to that point of 6 p.m. on May 21, then it will happen there, and until it happens, the rest of the world will be standing far off and witnessing the horrible thing that is happening.

His followers believe that about 200,000,000 people will be raptured, only 3% of the population.   For the rest of you, the world will end as you know it five months later on October 21st.Stock up on bullets and beef jerky, and pay heed to every word that Glenn Beck ever uttered.

Mr. Camping previously predicted the date for judgement day in September of 1994.   The only reason he was wrong then was because there needed to be more research done on the subject.   Really?  Thats the only reason he was wrong?   Harold is “absolutely sure” this time.

Ok try and follow this,   I will explain it simply and correctly.,   May 21st. 2+1 = 3.   There are 3 parts of the holy trinity.     There are also 3 letters in May.    May 21st is the birthday of Notorious B.I.G.    What does B.I.G. stand for?    Believe in God.   The month of May.    Add an “o” you get Mayo.    Mayonnaise has a lot of calories.   CALories, like in CALifornia.    Who was just the governor of California?    Arnold Schwarzenegger – who starred in Terminator 2 – JUDGMENT DAY!.    You just gotta connect the dots.    Thats how Harold calculated the exact day of the end of the world.

It is important to note, that the majority of Christian organizations have denounced this prophecy.    But have they heard  “The Mayo”  argument.      Do I need to tell you Harold has more than just a few screws loose,  he might have none connected at all.     Its not that his elevator doesn’t go to the top, he doesn’t have an elevator.    Its not that he’s a few cans short of a six pack, he a bone dry nut.    Harold even believes the Paul Ryan Budget Plan will save Medicare and that the GOP represents the poor and middle class.

Nevada State Committee Disaffiliates Its County and Regional Committees

In a surprise move without precedent or advance warning, the Libertarian Party of Nevada State Committee disaffiliated its three County/Regional Committees, which cover Las Vegas, Reno, and the Capital District. Readers of this newspaper may recall that the Clark County, Nevada LP group is financially independent of their state party, files separately with the FEC, and raises more money than a large fraction of all LP State Par-ties.

The Clark County LP has already responded. Debra Dedmon, writing on IPR, reports: The Libertarian Party of Clark County is valid due to the bylaws violation. The remaining members have elected Angela McKinster Chair .

Motion #1 I move that we have three Libertarian Party of Nevada membership levels. These levels would also main-tain national sustaining membership status as defined in (inaudible): level 1 annually, level 2 3.12 annually, and level 3 which would be 76 annually.

This is Dave Colborne. Out of curiosity, are we actually al-lowed to do this? Our bylaws leave membership fees to the lo-cal affiliates presently.
I don‘t know. Irv do you want to address this?
Irv: I‘m not aware of any bylaws. It wouldn‘t change our by-laws so it wouldn‘t change our qualifications for membership according to our state bylaws.
This is descriptions of donor levels. We‘re not really changing our state bylaws. That‘s all it is, just establishing three different levels. We can come up with names later. Basic membership, just the fifty to force the uh (unintelligible), the next level equates to .76 per month, and the last level is the 76 for hopefully new members, big bucks ( big deep pockets).
Colborne: So, just as a question, would this override the local membership program or would it be on top of the local mem-bership program? Answer: It just establishes three different names for the three different levels, that‘s all.
Colborne: Well the problem here is that and I hate quoting by-laws here but according to them any affiliated areas under article 3 section A all members of an affiliate party in Nevada are members of the LPN provided that the region has joined the local membership program, which basically requires forward-ing ten dollars to the executive committee for each member registered in the affiliate. I personally have no problem, the 1776 brigade and things like that, accepting membership levels beyond whatever the affiliates currently have. I just want to make sure that those who live in Clark County and Nye County where they don‘t have dues or have dues that are considerably lower than fifty dollars are still members of state. I just want to be sure that is cleared up.
I can answer that. Nothing we do as an executive committee changes our bylaws, and I‘m sure you‘re aware of that. Our Bylaws and our constitution do not create any kind of donor level or membership level. This just establishing a description rather than as establishment who is a member or not. Right we now we have membership as just as you quoted, that‘s what governs our body so I don‘t see this as a conflict. Nothing we do can change our bylaws. We have to do that at a state convention.
Colborne OK. Mostly I wanted to make sure that was clear to the entire body. I‘ve got no problem with raising some extra money and having some extra donation levels. That‘s fine.
[Editor: There is then a vote. The motion appears to pass unanimously. We then reach the next motion, under which all regional affiliates are disaffiliated, meaning that the dues levels just voted cover the entire state.]
I move to consolidate the Libertarian Party of Nevada by revoking the affiliate status of all Nevada county chapters including the Libertarian Party of Clark County, The Capi-tol Libertarian Party, and the Nye County Libertarian Par-ty thereby folding them into one organization until such time as membership levels (?) have reached (?) rechartering of county organizations.
Colborne: I was expecting Irv to speak in favor of his motion before chiming in.
Irv: I really don‘t have anything to say. This thing speaks for itself. I just think it‘s a good time for consolidation.. (short problem with background noise)
Colborne: Why are we doing this? I guess that would be my first question.
Chair: David, are you speaking for this or against this? I guess that could be my first question.
All right, I‘ll go ahead with this and I‘ll speak against it. As-suming we go though we this and assuming that you vote in favor of this, which I have a sneaking suspicion you probably will, you are talking about requiring all perspective candidates from (list of counties) to go down to Clark County to be even considered on their local ballots. I really think this is inappro-priate. I don‘t believe this will help grow the Libertarian Party of Nevada. I fail to see how this will increase activism, increase donations, or otherwise improve the functioning of our state especially since the largest most successful state parties in the country namely the Libertarian Parties of California and Texas have heavily relied on local and county affiliates and the Republicans and Democrats as much as you may dislike their ideologies win elections using local county and even precinct level organizations, so I think it‘s kind of unfortunate that we‘re talking about moving away from that direction.

I would like to speak against that. In Nye County we‘re grow-ing pretty rapidly. I think that if we consolidate you‘ll ruin what we‘re starting here.

We meet once a month. We had more people in our region than we‘ve ever had before. That‘s not going to happen if we consolidate.

A Report on the Recent Constitution Party National Committee Meeting

By every measure…attendence…energy and enthusiasm….reception for the speakers….and simply in terms of overall accomplishment…the Spring 2011 Constitution Party National Committee Meeting and Conference in Harrisburg was considered a major triumph!  Many said it was the best they ever attended, though travel for many of the members coming from the South and Midwest got off to a very rocky start due to storms across much those parts of the country.

Once everyone was finally assembled–and even before some arrived– the meeting hit a positive stride on Friday morning with dramatic presentations by Ohio’s Robert Owens, and Pennyslvania’s Peg Luksik on Friday morning followed by a tour of the beautiful Pennsylvania State Capitol Building.  On Friday afternoon John McManuns, president of the John Birch Society, provided a sobering picture of the history of the United Nations and Chelene Nightingale put the magic of her dynamic personality on display during a powerfully motivational address where she reviewed her 2010 campaign for Governor in California and exhorted everyone to continue to make the greatest possible effort to build the Constitution Party.

The Friday Night banquet featured a lively auction conducted by Midwestern StatesCo-Chairmen, Randy Stufflebeam (IL) and Scott Bartlett (SD) which raised money for the national committee’s operational fund.

The featured speaker, Sheriff Richard Mack received a thunderous standing ovation after he completed his address on the role of the County Sheriff in saving our Republic.  Mack endorsed numerous Constitution Party candidates in 2010,   It is certainly hoped that he will not be a stranger at Constitution Party events in the future.  Many at the meeting voiced a hope that he would play a high profile role for the Constitution Party in the upcoming 2012 election.

Also highlighting the banquet were two awards presented to three term national CP chairman, Jim Clymer–the America First Award presented on behalf the the Constitution Party’s National Veterans Coalition and the Excellence in Leadership Award presented on behalf of the Lancaster (PA) County Committee of the Constitution Party.

The energy remained at a high level on Saturday the 3oth.  The morning was kicked-off with an informative and entertaining portrait of Pennsylvania provided by Jim Panyard, former President of the Pennsylvania Manufacturing Association, followed by an intriguing and warmly received review of the current political situation, including the work of the so-called Human Rights Tribunals, provided by Victor Chiasson a political conservative from Ottawa Canada with very close ties to the Constitution Party.  Without a doubt, Dr.Taylor Haynes of Wyoming, who secured about 8% of the vote as a write-in candidate for Governor in 2010 was one of the real crowd favorites.  A newcomer to the Constitution Party, Dr. Haynes is a man of enormous personal accomplishment–any one of the items on his lengthy resume’ would probably thrill most us–yet great humility.  His discussion of the 2010 campaign, which he centered on the Constitution and the Ten Commandments, inspired everyone in attendance. Darrell Castle provided an information packed overview of the situation in the Middle East raising very justifiable questions concerning the role that has been played by the United States over the years in the part of the world.  His presentation brought specific praise from the last speaker, former Virginia Congressman Virgil Goode who, as noted above said that it is time that America start taking care of its own serious problems rather than trying to cure the rest of worlds ails. The general consensus was that it was Goode’s finest and most powerful address since he first started attending Constitution Party national meetings in 2009  and was a portent of great things to come.
